Terms of Service

1. Acceptance of Terms

By accessing or using CMMC Ready's services at cmmc.barsec.tech, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Description of Service

CMMC Ready provides a self-service platform for DoD contractors to:

• Self-assess compliance against CMMC 2.0 Level 1 and NIST SP 800-171 Rev 2 controls
• Generate gap analysis reports and compliance scoring
• Track remediation progress and maintain compliance evidence
• Access educational content and compliance newsletters

3. Eligibility

You must be at least 18 years old and have the authority to bind yourself or your organization to these terms to use our services.

4. Accounts and Security

• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized access
• We may suspend or terminate accounts that violate these terms

5. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to access other users' data or reports
• Reverse engineer, decompile, or disassemble any part of the service
• Use automated tools to scrape or harvest data from the platform
• Submit false or misleading compliance data

6. Payment and Billing

6.1 Free Tier

The free tier includes one saved assessment with limited features. No payment information is required.

6.2 Paid Plans

Subscriptions and one-time purchases are processed through Stripe. By subscribing, you authorize us to charge the payment method on file according to the selected plan's pricing.

6.3 Refunds

One-time purchases may be eligible for a refund within 14 days if the service has not been significantly used. Subscription fees are non-refundable but may be cancelled at any time.

6.4 Price Changes

We reserve the right to modify pricing with 30 days' notice. Existing subscriptions will continue at the current rate until the next billing cycle.

7. Intellectual Property

The CMMC Ready platform, including its design, code, and branding, is our intellectual property. CMMC 2.0 and NIST SP 800-171 content are public frameworks published by the U.S. Department of Defense and NIST respectively.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. We do not guarantee that:

• Your assessment results will result in successful CMMC certification
• The service will be uninterrupted or error-free
• Our gap analysis will identify every compliance deficiency

CMMC Ready is a self-assessment tool. It does not replace a formal C3PAO assessment or legal compliance advice.

9. Limitation of Liability

IN NO EVENT SHALL CMMC READY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising from your use of the service, including but not limited to loss of data, failed audits, or compliance penalties. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless CMMC Ready from any claims, damages, or expenses arising from your use of the service, violation of these terms, or infringement of third-party rights.

11. Termination

We may terminate or suspend your account at any time, with or without cause. Upon termination, you may request export of your data within 30 days.

12. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in the appropriate courts.

13. Changes to Terms

We may update these terms at any time. Material changes will be communicated via email or in-app notice. Continued use after changes constitutes acceptance.
